Ticket Terms and Conditions of Sale

  1. Tickets for performances are valid only when purchased from Darwin Festival or an organisation authorised by Darwin Festival to sell or distribute tickets. All Consumers must have a valid ticket for a performance.
  2. Where concessions are applicable, suitable and valid identification must be provided by a Consumer for collection of tickets and for admission to a performance.
  3. All ticket prices are stated in Australian Dollars and include GST where applicable. A $2.50 non-refundable transaction fee applies on all ticket purchases. The revenues generated by the application of a transaction fee are a direct support for the activities of the Darwin Festival and for the facilities we operate. Payment Processing Fee. We accept payment for transactions by cash, gift voucher or credit card.  When you use a credit or debit card to pay for your transaction, a processing fee of no more than 1.5% will apply. This fee covers the necessary infrastructure to operate the payment gateway to allow for real-time credit/debit card transactions and to cover the merchant and clearance charges imposed upon us by the institutions we operate with.  The fee will be calculated on the total value of your transaction. The fee does not apply for transactions paid for by cash or using a gift voucher.
  4. Prices are subject to change at any time without notice.
  5. If you have selected delivery by mail, please allow at least 14 days for your order to arrive at your nominated address.  Opting to have your tickets sent via Registered post will incur an additional $5.50 fee to cover costs incurred.
  6. The right is reserved to not replace lost or stolen tickets where seating is general admission. For reserved seat tickets Darwin Festival, at its discretion, may be able to replace the ticket if the Consumer produces adequate proof of purchase. Darwin Festival encourages tickets purchased to be treated like cash.
  7. No refunds or exchanges permitted except as provided in the Australian Live Entertainment Industry Code of Practice. If the event organiser permits refunds, the customer booking fee included in the advertised ticket price is non-refundable.
  8. Darwin Festival collects your individual information in case of an event cancellation or alteration. If you fail to supply sufficient and appropriate contact information Darwin Festival is not responsible for failure to contact you.
  9. If an event is cancelled no obligation is assumed by Darwin Festival for arranging a substitute event. 
  10. Tickets may be exchanged only where expressly permitted by Darwin Festival and may be subject to certain conditions and additional fees.
  11. Entry to a Venue is at an individual’s own risk.  To the maximum extent permitted by law, Darwin Festival will not be responsible for any loss, damage, harm or injury arising from a Consumers entry to a Venue or performance within a Venue.
  12. The right to refuse entry or to evict a Consumer is reserved by Venue Management as provided in the Australian Live Entertainment Industry Code of Practice
  13. Latecomers will be only admitted to a performance during a suitable break or as determined by Venue Management. Under some circumstances this may mean the Consumer misses the show in its entirety.
  14. Tickets must be retained throughout the performance and Venue Management reserve the right to evict any person or persons not in possession of a valid ticket.
  15. The right is reserved to vary, substitute or withdraw advertised programs, artists, venue and seating arrangements as necessary.
  16. A valid Companion Card or valid Companion Card Number must be produced at the time of booking to gain access to the Companion Card Scheme offer. Details of use are contained on the Companion Card website.
  17. Cameras and other recording devices are prohibited in a venue's auditorium.
  18. Mobile telephones, pagers and so forth must be switched off during a performance.
  19. In attending a performance, you grant Darwin Festival permission to film or photograph you, and to reproduce that film or photograph in any audio, video or photographic display or other transmission, exhibition, publication or reproduction in any medium or context without further authorisation by, or compensation to, you.
  20. Tickets may not, without Darwin Festival’s written consent, be on-sold at a premium, offered as a prize or inducement, packaged or otherwise used for advertising, promotional or other commercial purposes. Darwin Festival reserves the right to refuse admission to the bearer of any ticket sold or otherwise provided or distributed in breach of this condition.
